บริษัท ยามาซ่า เอเชีย โอเชียเนีย จำกัด (ต่อจากนี้จะเรียกว่า “YAO” หรือ “เรา”) มุ่งมั่นที่จะปกป้องคุ้มครองและเคารพความเป็นส่วนตัวของท่าน เราต้องการแจ้งให้ท่านทราบว่าเราใช้และปกป้องคุ้มครองข้อมูลส่วนบุคคลของท่านอย่างไร ซึ่งรวมถึงการแจ้งสิทธิเกี่ยวกับข้อมูลส่วนบุคคลของท่านที่เราเก็บไว้

2. ข้อมูลส่วนบุคคลประเภทใดบ้างที่ YAO ทำการเก็บรวบรวมจากท่าน

4. ฐานในการประมวลผลข้อมูลส่วนบุคคล

เราอาจทำการประมวลผลข้อมูลส่วนบุคคลของท่านเนื่องจาก

เป็นการจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของเราหรือของบุคคลภายนอกอื่นในการดำเนินธุรกิจของเรา เว้นแต่ประโยชน์ดังกล่าวมีความสำคัญน้อยกว่าประโยชน์หรือสิทธิขั้นพื้นฐานและเสรีภาพของท่าน

หรือเมื่อมีความจำเป็นในกรณีดังต่อไปนี้

เป็นการจำเป็นเพื่อการปฏิบัติตามสัญญาซึ่งท่านเป็นคู่สัญญาหรือเพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญา
เป็นการปฏิบัติตามกฎหมายของเรา

เพื่อการปฏิบัติหน้าที่ในการดำเนินภารกิจเพื่อประโยชน์สาธารณะหรือปฏิบัติหน้าที่ในการใช้อำนาจรัฐที่ได้มอบให้แก่เรา
เพื่อให้บรรลุวัตถุประสงค์ที่เกี่ยวกับการจัดทำเอกสารประวัติศาสตร์หรือจดหมายเหตุ เพื่อประโยชน์สาธารณะ หรือที่เกี่ยวกับการศึกษาวิจัยหรือสถิติซึ่งได้จัดให้มีมาตรการปกป้องที่เหมาะสม เพื่อคุ้มครองสิทธิและเสรีภาพของท่าน

5. การเปิดเผยข้อมูลส่วนบุคคลของท่าน

ในการดำเนินการตามวัตถุประสงค์ตามที่ได้กล่าวมาข้างต้น เราอาจเปิดเผยข้อมูลส่วนบุคคลของท่านแก่สมาชิกบริษัทอื่นๆในกลุ่มบริษัทยามาซ่า รวมถึงสมาชิกตามที่ระบุไว้ด้านล่างนี้ (เรียกรวมกันว่า “สมาชิกกลุ่มยามาซ่า”) บุคคลภายนอกซึ่งให้บริการแก่เราและ/หรือสมาชิกกลุ่มยามาซ่าอื่นๆ (เช่น ธนาคาร ผู้ให้บริการจัดส่ง ผู้ให้บริการขนส่ง เป็นต้น) เจ้าหน้าที่หรือหน่วยงานที่มีอำนาจตามที่กฎหมาย ข้อบังคับหรือคำสั่งให้อำนาจไว้ (รวมถึงศาลและหน่วยงานที่กำกับดูแลเราหรือสมาชิกกลุ่มยามาซ่าอื่นๆ) และบุคคลภายนอกอื่นๆ ที่ต้องการเข้าถึงข้อมูลส่วนบุคคลที่เกี่ยวข้องกับท่านตามวัตถุประสงค์อย่างหนึ่งอย่างใดตามที่ได้กล่าวมาข้างต้น

6. การส่งหรือโอนข้อมูลส่วนบุคคลไปยังต่างประเทศ

เราอาจส่ง โอน หรือเก็บข้อมูลส่วนบุคคลของท่านตามที่กล่าวมาข้างต้นที่ต่างประเทศ ทั้งนี้ ประเทศปลายทางเหล่านี้อาจไม่มีระดับการคุ้มครองข้อมูลส่วนบุคคลที่เท่าเทียมกับประเทศไทย ในกรณีเช่นนี้เราจะทำให้แน่ใจว่า เราได้จัดให้มีมาตรการคุ้มครองที่เพียงพอเพื่อปกป้องคุ้มครองข้อมูลส่วนบุคคลของท่านซึ่งเป็นไปตามหน้าที่ตามกฎหมายของเรา

7. ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล

เราจะไม่เก็บรักษาข้อมูลส่วนบุคคลของท่านไว้นานเกินกว่าที่กำหนดไว้เพื่อวัตถุประสงค์ซึ่งเก็บรวบรวม

เราจะเก็บรักษาข้อมูลส่วนบุคคลของท่านดังนี้

ตราบเท่าที่กฎหมายหรือข้อบังคับที่เกี่ยวข้องกำหนด
จนกว่าเราจะไม่มีเหตุผลที่เหมาะสมในการเก็บรักษาข้อมูลส่วนบุคคลนั้นแล้ว และ
จนกว่าเราจะได้รับคำร้องขอให้ลบข้อมูลส่วนบุคคลจากท่าน

8. มาตรการคุ้มครองความปลอดภัย

YAO มุ่งมั่นที่จะทำให้ท่านแน่ใจว่าข้อมูลส่วนบุคคลของท่านถูกเก็บรักษาอย่างปลอดภัย ในการนี้ เพื่อป้องกันการเข้าถึงหรือเปิดเผยข้อมูลส่วนบุคคลโดยปราศจากอำนาจหรือโดยไม่ชอบ YAO ได้จัดให้มีมาตรการที่เหมาะสมทั้งทางด้านเทคนิคและด้านองค์กรเพื่อปกป้องและรักษาความปลอดภัยข้อมูลส่วนบุคคลของท่านตามหลักเกณฑ์และมาตรฐานที่คณะกรรมการคุ้มครองข้อมูลส่วนบุคคลกำหนด ทั้งนี้ พนักงานและบุคลากรของ YAO ทุกคน รวมถึง บุคคลภายนอกซึ่งประมวลผลข้อมูลส่วนบุคคลของท่านในนามของYAO มีหน้าที่จะต้องรักษาความลับของข้อมูลส่วนบุคคลของท่านด้วย

9. สิทธิของท่าน

ท่านมีสิทธิต่างๆ เกี่ยวกับข้อมูลส่วนบุคคลของท่าน โดยเฉพาะอย่างยิ่ง ท่านมีสิทธิในการขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่าน สิทธิในการแก้ไขทำให้สมบูรณ์และลบข้อมูลส่วนบุคคลของท่านซึ่งเราเก็บรวมรวบอยู่ รวมถึง สิทธิในการคัดค้านหรือระงับการประมวลผลข้อมูลส่วนบุคคลบางประเภท นอกจากนี้ ท่านมีสิทธิในการส่งหรือโอนข้อมูลส่วนบุคคล ทั้งนี้ ในกรณีที่การประมวลผลข้อมูลส่วนบุคคลใดๆ อาศัยความยินยอมเป็นฐานในการประมวลผลข้อมูลส่วนบุคคลนั้น ท่านมีสิทธิในการถอนความยินยอมในการประมวลผลข้อมูลส่วนบุคคลดังกล่าวได้ทุกเมื่อ อย่างไรก็ตามการถอนความยินยอมย่อมไม่ส่งผลกระทบต่อการประมวลผลข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมไปแล้วแก่เรา

10. การร้องเรียน

ท่านมีสิทธิร้องเรียนต่อคณะกรรมการคุ้มครองข้อมูลส่วนบุคคลได้ หากพบว่า YAO ไม่ดำเนินการตามคำขอของท่าน หรือเราจัดการข้อมูลส่วนบุคคลของท่านโดยไม่ชอบด้วยกฎหมาย

11. ภาระผูกพันตามสัญญาหรือตามกฎหมาย

ข้อกำหนดเกี่ยวกับข้อมูลส่วนบุคคลไม่ก่อให้เกิดภาระผูกพันทางกฎหมายหรือตามสัญญา หรือข้อกำหนดที่จำเป็นในการเข้าทำสัญญา อย่างไรก็ตาม YAO ขอสงวนสิทธิในการลดหรือยกเลิกความสัมพันธ์ตามสัญญากับท่านในกรณีที่ท่านไม่ให้ความร่วมมือในการให้ข้อมูลส่วนบุคคลซึ่งจำเป็นต่อการปฏิบัติตามสัญญาแก่เรา

12. เด็ก

YAO ไม่ได้ดำเนินการเก็บรวบรวมข้อมูลส่วนบุคคลของบุคคลซึ่งมีอายุต่ำกว่า 10 ปี ในกรณีที่ท่านเป็นผู้ใช้อำนาจปกครองของเด็กที่มีอายุต่ำกว่า 10 ปี ประสงค์ที่จะให้ข้อมูลส่วนบุคคลของบุคคลนั้นแก่ YAO ในกรณีดังกล่าวเราจะดำเนินการขอความยินยอมของท่าน

13. คุกกี้ (Cookies)

คุกกี้

คุกกี้ คือ ไฟล์ข้อมูลขนาดเล็กที่บันทึกอยู่ในเครื่องคอมพิวเตอร์หรืออุปกรณ์อื่นๆ ของท่าน (เช่น สมาร์ตโฟน แล็ปท็อป แท็บเล็ต) เมื่อท่านเข้าชมเว็บไซต์ของ YAO คุกกี้ช่วยให้เว็บไซต์จดจำพฤติกรรมหรือความชอบของท่านเมื่อเวลาผ่านไปได้

1. Introduction

Yamasa Asia Oceania Co., Ltd. (hereinafter referred to as “YAO”) is committed to protect and respect your privacy. We would like to inform you how we use and protect your personal data. This includes informing you of your rights regarding your personal data that we hold.

This Privacy Notice sets out how we may collect, use, and disclose your personal data by processing, in accordance with the Personal Data Protection Act B.E. 2562 (“PDPA”) and any other relevant laws and regulations. 2. What Personal Data YAO may collect from you

We may collect or obtain personal data about you because you or your company give it to us (for example through a inquiry form on our website, several types of event that the Company holds, and establishing a business relationship with you or your company) and will use or disclose your personal data in accordance with the original purposes you have given. We may also collect or obtain your personal data because we observe or infer information about you from the way you interact with us or others. In connection with one or more of the purposes said above, we may disclose your personal data to: other members of Yamasa group companies including those listed below (collectively “Yamasa Members”); third parties that provide services to us and/or other Yamasa Members (such as banks, shipping providers, transportation service providers, etc.); competent authorities as required by laws, regulations, or orders (including courts and authorities regulating us or other Yamasa Members) and other third parties that reasonably require access to personal data relating to you for one or more of the purposes said above.

6. International transfer of personal data

Please note that your personal data referenced above may be transferred to and stored at countries outside of Thailand whose laws may not provide the same level of data protection. In such cases, we will ensure that there are adequate safeguards in place to protect your personal data that comply with our legal obligations.

We will not retain your personal data for longer than required for the purposes for which the personal data are processed.

For as long as required by relevant laws or regulations;
Until we no longer have a valid reason for keeping it; and
Until we receive your request to delete.

YAO is committed to ensure that your personal data is kept secure. In order to prevent unauthorized access or disclosure, YAO has put in place appropriate technical and organizational measures to safeguard and secure your personal data in accordance with rules and standards to be specified by the Personal Data Protection Committee. All YAO personnel and the third parties which process your personal data on behalf of YAO are obliged to respect the confidentiality of your personal data.

9. Your rights

You have various rights in relation to your personal data. In particular, you have the right to request access and obtain copy, correct and delete your personal data which we hold, as well as the right to restrict or object to certain types of processing of your personal data. Furthermore, you have the right to data portability. If the processing relies on your consent, you have the right to withdraw your consent at any time. The withdrawal shall not affect the processing of personal data you have given consent to.

10. Complaints

If you feel that YAO has not responded to your requests and have handled your personal data unlawfully, you have the right to submit a complaint to the Personal Data Protection Committee.

11. Contractual or statutory obligation
