Section 1a(1) shall not be effected thereby. Should the patentee or a third party with the consent of patentee put biological material possessing certain characteristics owing to the invention on the market within the territory of a Member State of the European Union or in a contracting state of the European Economic Area Agreement and should further biological material be produced from this biological material by multiplication or propagation, the effects of Section 9 shall not come into force if the propagation of the biological material was the reason why this was put on the market. (2) The following biotechnological inventions shall not be protected by a patent: 1) processes for cloning human beings; 2) processes for modifying the germ line genetic identity of human beings; 3) uses of human embryos for commercial purposes, including processes prohibited by the Artificial Insemination and Embryo Protection Act 4) processes for modifying the genetic identity of animals which are likely to cause them suffering without any substantial benefit to man or animal, and animals resulting from such processes; 5) essentially biological processes for the derivation of biological materials or the production of plant or animal varieties, except microbiological processes for the derivation of micro-organisms; 6) inventions the application of which is confined to a single plant or animal variety.発音を聞く  - 特許庁

(3) In accordance with Section 9, Paragraph four of this Law, a patent shall not be granted to biotechnological inventions that pertain to: 1) human cloning; 2) modification of the genetic identity of human beings in germ cells; 3) use of human embryos for industrial or commercial purposes; and 4) methods for modifying the genetic identity of animals, which are likely to cause them suffering without any substantial medical benefit to people or animals, as well as animals resulting from such methods. - 特許庁

Patents shall not be granted to inventions, whose commercial exploitation would be contrary to public policy or to principles of morality, namely to processes for cloning human beings, processes for modifying the germ line genetic identity of human beings, processes of using human embryos for industrial or commercial purposes or processes for modifying the genetic identity of animals, which are likely to cause them suffering without any substantial medical benefit to man or animal, and also to animals resulting from such processes; however, the contradiction to public policy or to principles of morality shall not be deduced merely from the fact that the exploitation of the invention is prohibited by legal regulation, human body at various stages of its formation and development, and the simple discovery of one of its elements, including the sequence or partial sequence of a gene; it does not apply to an element isolated from the human body or otherwise produced by means of a technical process, including the sequence or partial sequence of a gene, even if the structure of that element is identical to that of a natural element, and plant and animal varieties or essential biological processes for the production of plants or animals.発音を聞く  - 特許庁
